We are not legally required to appoint a data protection officer and have not done so. If you have any questions about data protection, please contact us directly at the address above.

Which law applies

We are based in Germany, so our processing of personal data is governed by the EU General Data Protection Regulation (GDPR) and German data protection law. If you visit this website from the United Kingdom, the UK GDPR and the Data Protection Act 2018 may also apply to you. The rights described below apply under both regimes.

Hosting

This website is hosted by Netlify. The provider is Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA.

When you visit the site, Netlify processes technically necessary access data (server log files) on our behalf as our processor. This includes your IP address, the date and time of access, the file requested, the amount of data transferred, browser type and operating system, and the page you visited previously. This data is needed to deliver the website, keep it stable and secure, and defend against attacks.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest lies in running the website reliably and securely. As Netlify also processes data in the USA, transfers take place on the basis of the European Commission's Standard Contractual Clauses and the EU-US Data Privacy Framework; for visitors from the UK, the corresponding UK transfer mechanisms apply. We have concluded a data processing agreement with Netlify.

Storage in your browser

This website does not set any tracking cookies. Only two entries are stored in your browser's local storage:

  • vb-consent-v1 stores your choice in the cookie notice so that it does not reappear on every visit. It remains until you clear your browser data.
  • vb-tapes-seen remembers for the duration of your visit that the VB Tapes notice has already been shown. It is deleted automatically when you close the browser tab.

Both entries stay in your browser, are not transmitted to us or third parties and contain no personal data. They are strictly necessary for the function you requested (Section 25(2) no. 2 of the German TDDDG; for UK visitors, the corresponding exemption under the Privacy and Electronic Communications Regulations, PECR).

You can change your choice at any time via the Cookie settings link in the footer of the homepage.

Analytics and marketing

No analytics, statistics or marketing services are currently in use. There is no audience measurement, no profiling and no social media pixel is loaded.

The cookie notice already offers the categories Analytics and Marketing. Should such services be used in future, they will only be loaded after your explicit consent. The legal basis would then be Section 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR. We will update this policy in advance if that happens.

Fonts

All fonts used on this website are served locally from our own server. Loading the pages does not create a connection to third-party servers.

Third-party content

This website does not embed content from external servers. All images, graphics and fonts are delivered from our own server. No videos are embedded, no maps are loaded and no social media plug-ins are used.

Links to social networks

In the footer we link to our profiles on Instagram, TikTok and LinkedIn. These are plain text links without plug-ins. Data is only transmitted to these providers if you actively click a link and visit the platform, where the provider's own privacy policy applies.

Contacting us

There is no contact form on this website. You can contact us by email, phone or WhatsApp.

When you contact us, we process your details solely to handle your enquiry and any follow-up questions. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a contract, and otherwise Art. 6(1)(f) GDPR based on our legitimate interest in responding. We delete your enquiry once it has been dealt with, unless statutory retention periods apply.

If you contact us via WhatsApp, data is processed on the servers of Meta Platforms Ireland Limited. If you would rather avoid this, please use email or phone.

How long we keep data

Server log files are deleted or anonymised automatically after a short period. We keep enquiries and the resulting business correspondence for as long as needed for our work together. Statutory retention periods under German commercial and tax law of six and ten years remain unaffected.

Your rights

You have the right at any time to:

  • access the personal data we hold about you (Art. 15 GDPR / UK GDPR)
  • have inaccurate data corrected (Art. 16)
  • have your data erased (Art. 17)
  • restrict processing (Art. 18)
  • data portability (Art. 20)
  • withdraw any consent you have given, with effect for the future (Art. 7(3))

Right to object: where we process data on the basis of legitimate interests under Art. 6(1)(f), you may object to this processing under Art. 21 on grounds relating to your particular situation.

To exercise your rights, simply send an informal message to hello@thevbagency.de.

Right to complain

You have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the Bavarian Data Protection Authority (Bayerisches Landesamt für Datenschutzaufsicht), Promenade 27, 91522 Ansbach, Germany, www.lda.bayern.de.

If you live in the UK, you can also contact the Information Commissioner's Office (ICO), ico.org.uk.

Secure transmission

This website is delivered exclusively over an encrypted HTTPS connection, shown by the padlock in your browser's address bar. Data you transmit cannot easily be read by third parties.

Changes to this policy

We update this privacy policy whenever the technical set-up of the website or the legal requirements change. The version published here applies to your visit.
